ASIL TRADING PTY LTD ATF ASIL TRADING UNIT TRUST (Migration)

The Administrative Appeals Tribunal (AAT) considered an application by ASIL TRADING PTY LTD ATF ASIL TRADING UNIT TRUST for the approval of a nominated position under the Direct Entry stream. The dispute concerned whether the applicant met the requirements for approval of the nomination, specifically in relation to the training requirements for the position.

The Tribunal also considered other requirements, including the nominator's business operations, employment terms, absence of adverse information, and compliance with workplace relations laws.

The Tribunal's reasoning focused on the evidence presented regarding the nominator's business, the nominee's qualifications and experience, and the genuine need for the position. The Tribunal found that the business was actively and lawfully operating, and that the nominee possessed the necessary skills and experience for the IT role. Crucially, the Tribunal was satisfied that the applicant met the training requirements as specified in the relevant legislative instruments, despite the initial decision under review having found otherwise. The Tribunal noted that the nominee had appropriate qualifications and over ten years of experience, and that the applicant had provided evidence of client testimonials and detailed descriptions of the nominee's duties.

Consequently, the Tribunal set aside the original decision and substituted a new decision approving the nomination.
