CaseChat Overview and Summary

The Administrative Appeals Tribunal reviewed a decision to cancel Mr. Arora's Subclass 491 Skilled Work Regional (Provisional) visa. The dispute arose because Mr. Arora was no longer the member of the family unit of the primary visa holder, his former wife, due to the breakdown of their marriage. The Tribunal, constituted by Member Mary Sheargold, considered whether the grounds for cancellation existed and, if so, whether the visa should be cancelled in the exercise of discretion.

The primary legal issue before the Tribunal was whether the circumstances that permitted the grant of Mr. Arora's visa under section 116(1)(a) of the Migration Act 1958 (Cth) no longer existed. This required determining if the marital relationship, which was the basis for his visa as a secondary applicant, had genuinely ceased. The Tribunal also had to consider whether, if the ground for cancellation was established, it was appropriate to exercise the discretion not to cancel the visa, taking into account all relevant circumstances.

The Tribunal found that the ground for cancellation under section 116(1)(a) was made out, as Mr. Arora was no longer married to the primary visa holder, Ms. Diksha Wadhwa. However, the Tribunal then exercised its discretion not to cancel the visa. It reasoned that while the original purpose of Mr. Arora's stay in Australia had ceased, he had since remarried an Australian permanent resident who was unwilling to return to India. Furthermore, Mr. Arora had a history of complying with his visa conditions and had notified authorities of his change of address promptly. The Tribunal accepted that cancelling his visa would cause him significant emotional hardship, particularly given his ongoing recovery from emotional abuse during his previous marriage and the potential separation from his new wife.

Consequently, the Tribunal set aside the decision to cancel Mr. Arora's visa and substituted a decision not to cancel it.
