ARLINGTON & BUZZOTTI

In the matter of *Arlington & Buzzotti*, Hogan J of the Family Court of Australia considered an application by Mr Arlington seeking the enforcement of an order made on 10 April 2015, and an application for costs. The dispute concerned the total amount owing by Ms Buzzotti to Mr Arlington under the previous order, and whether interest should be applied.

The court was required to determine the precise amount outstanding under the existing order, including any accrued interest, and to make orders for its payment. Additionally, the court had to consider the Applicant's claim for costs associated with an interim application filed on 24 December 2015.

Hogan J applied Rule 20.07(a) of the Family Law Rules 2004 to declare the total amount owing by Ms Buzzotti to Mr Arlington as $19,052.61. The court ordered Ms Buzzotti to pay this sum in full by 30 July 2017. Furthermore, Ms Buzzotti was ordered to pay Mr Arlington's costs of and incidental to the interim application, to be agreed between the parties within 21 days or, failing agreement, assessed on a party/party basis, with payment due by 30 October 2017. Liberty to apply was granted to Mr Arlington regarding the enforcement of the order, with any further enforcement applications to be listed before Justice Hogan.
