Consequently, the resolution passed by the improperly constituted committee was invalid. The Court applied the principle that a decision made by a body lacking the requisite legal authority or quorum is a nullity.

The Court of Appeal allowed the appeal, set aside the order of the Supreme Court, and declared that the Council's refusal of the development application was invalid. The matter was remitted to the Council for determination according to law.
