The Tribunal reasoned that recovering small, ongoing amounts from the elderly and unwell applicants would cause them hardship without significant financial benefit to the Commonwealth, and that a swift conclusion to the matter would be fairer and more just. The decision under review was set aside, and the unpaid debts were waived under section 1237AAD of the Social Security Act 1991.
