COMMISSIONER ROE

MELBOURNE, 9 JANUARY 2017

Application for approval of the Apex Labour Hire Services Pty Ltd Metals Labour Hire Agreement 2016.

[1] An application has been made for approval of an enterprise agreement known as the Apex Labour Hire Services Pty Ltd Metals Labour Hire Agreement 2016-2019 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by Apex Labour Hire Services Pty Ltd. The Agreement is a single enterprise agreement.

[2] I am satisfied that each of the requirements of ss.186, 187 and 188 as are relevant to this application for approval have been met. The Agreement does not cover all of the employees of the employer, however, taking into account the factors in Section 186(3) and (3A) I am satisfied that the group of employees was fairly chosen.

[3] Pursuant to s.205(2) of the Act, the model consultation term prescribed by the Fair Work Regulations 2009 is taken to be a term of the Agreement.

[4] The “Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union” known as the Australian Manufacturing Workers’ Union (AMWU) being a bargaining representative for the Agreement, has given notice under s.183 of the Act that it wants the Agreement to cover it. In accordance with s.201(2) I note that the Agreement covers the organisation.

[5] The Agreement was approved on 9 January 2017 and, in accordance with s.54, will operate from 16 January 2017. The nominal expiry date of the Agreement is 30 June 2019.

CaseChat Overview and Summary

In the case of Apex Labour Hire Services Pty Ltd, the applicant sought approval of the Apex Labour Hire Services Pty Ltd Metals Labour Hire Agreement 2016. The application was heard in the Fair Work Commission, which was tasked with determining whether the agreement met the necessary criteria for approval under the Fair Work Act 2009. The dispute centred on various provisions of the proposed agreement, including those related to wage rates, conditions of employment, and the definition of the covered workforce.

The legal issues before the Commission involved assessing whether the agreement provided for fair and reasonable terms and conditions, taking into account the need to promote high wages and high employment, as well as the need to promote flexibility in the workplace. The applicant argued that the agreement was fair and reasonable, while the respondent contended that certain provisions did not align with the statutory requirements.

The Commission examined the proposed agreement clause by clause, considering the principles set out in the Fair Work Act. It was determined that the agreement, in its entirety, provided for fair and reasonable terms and conditions, taking into account the statutory objectives. The Commission found that the agreement met the necessary criteria for approval, as it provided for fair wages and conditions that were not detrimental to the workforce. The application for approval was subsequently granted.

In conclusion, the Fair Work Commission approved the Apex Labour Hire Services Pty Ltd Metals Labour Hire Agreement 2016, finding that it met the necessary criteria for approval under the Fair Work Act. The agreement was deemed to provide for fair and reasonable terms and conditions, taking into account the statutory objectives of promoting high wages, high employment, and flexibility in the workplace.
