CaseChat Overview and Summary

In the Annual Wage Review 2021–22, the Fair Work Commission was tasked with conducting an annual review of wages in accordance with the Fair Work Act 2009. The review involved considering submissions from various stakeholders, including the Australian Council of Trade Unions, the Australian Industry Group, and the United Workers Union. The primary objective was to assess the draft research program for the review and to determine whether any changes were necessary.

The key legal issue before the Fair Work Commission was whether the draft research program, as published on 18 October 2021, should be altered based on the submissions received. Each of the stakeholders provided suggestions for the conduct of the research, but none of them sought to change the research program fundamentally. The Commission needed to decide whether these suggestions warranted any modifications to the draft program.

Justice Ross, the President of the Fair Work Commission, confirmed the draft research program as published on 18 October 2021, after considering the submissions from the stakeholders. The suggestions provided by the stakeholders were taken into account, but no changes were deemed necessary. Consequently, the draft research program remained as it was initially published.
