The Administrative Appeals Tribunal considered an application by Angkurawirote for a subclass 500 Student visa. The Tribunal was satisfied that the applicant had demonstrated strong economic and financial ties to her home country, evidenced by prior employment and a comprehensive business plan for a restaurant in Thailand. Furthermore, the Tribunal noted the applicant's exemplary academic record in Australia, her consistent attendance at classes, and her academic progression, which indicated she was a genuine student. The Tribunal concluded that the applicant had established the value of her course to her future and that her conduct was consistent with that of a genuine temporary entrant.

Consequently, the Tribunal remitted the application to the Department for reconsideration with a direction that the applicant satisfies the criteria set out in clause 500.212(a) of Schedule 2 to the Migration Regulations 1994.
