CaseChat Overview and Summary
The primary legal issue before the Commission was whether the agreement complied with the provisions of the Fair Work Act 2009. Specifically, the Commission needed to assess whether the agreement was made in good faith, whether it was free from coercion or undue influence, and whether it contained the required minimum terms and conditions. The Commission also had to determine whether the agreement provided for a proper process for the resolution of disputes between the parties. The application for approval of the agreement was made by Amrick Civil Pty Ltd, and the Australian Workers’ Union supported the application.
In its decision, the Commission found that the agreement met the requirements of the Fair Work Act 2009. The Commission was satisfied that the agreement was made in good faith, was free from coercion or undue influence, and contained the required minimum terms and conditions. The Commission also found that the agreement provided for a proper process for the resolution of disputes between the parties. The Commission approved the agreement, and it came into effect on the date of the decision. The decision of the Commission is final and binding on the parties.
