Amiri & Elbaz

In the matter of *Amiri & Elbaz*, Morley J of the Federal Circuit and Family Court of Australia considered an application concerning the parenting arrangements for a child, X, born in 2005. The dispute centred on the nature and extent of the relationship between X and her father, Mr Amiri, with conflicting accounts presented by both Mr Amiri and the child's mother, Ms Elbaz.

The court was required to determine the best interests of X in relation to her living arrangements, time spent with each parent, and communication between X and her father. Key legal issues included the weight to be given to the primary considerations under section 60CC of the *Family Law Act 1975* (Cth), namely the benefit of a meaningful relationship with both parents and the need to protect X from harm. Morley J applied the principles of section 60CC of the *Family Law Act 1975*, acknowledging that while a meaningful relationship with both parents is a primary consideration, the need to protect a child from harm is to be given greater weight. In this instance, the court found that the evidence did not definitively establish a history of a relationship between X and her father, nor did it conclusively prove the mother's alleged alienation. Given the conflicting evidence and the child's age, the court determined that X should live with her mother. To facilitate X's ability to form a relationship with her father should she wish, the court ordered that the father provide his contact details to the Independent Children's Lawyer, who would then inform X. X would be empowered to arrange time with her father according to her own wishes, with both parents required to facilitate this. The court also made orders regarding the exchange of educational and medical information and restrained both parents from making derogatory comments about each other in X's presence.
