Amendment of Court of Petty Sessions Rules (ACT)

The Attorney-General of the Commonwealth made amendments to the Court of Petty Sessions Rules, introducing new procedures for the service of foreign documents and the obtaining of evidence for foreign tribunals. The amendment introduced new rules regarding the service of foreign documents on individuals in the Territory for the Seat of Government and the obtaining of evidence for foreign tribunals under international conventions. The legal issues before the court were whether the Attorney-General had the authority to make such amendments and if the amended rules were in line with the existing legislation. The court held that the Attorney-General had the authority to amend the rules, as it was within the scope of the powers conferred by the Court of Petty Sessions Ordinance. The court also found that the amended rules were consistent with the existing legislation, as they were designed to facilitate the enforcement of foreign judgments and to comply with international conventions. The court concluded that the amendments were valid and should be applied accordingly. The court ordered that the amended rules come into operation forthwith.
