Application for approval of the Ambulance Victoria Enterprise Agreement 2024
Ambulance Victoria has applied for approval of an enterprise agreement known as Ambulance Victoria Enterprise Agreement 2024 under s 185 of the Fair Work Act 2009.
The Agreement is a single enterprise agreement.
I observe that Clause 74.2 – Public Holidays – is likely to be inconsistent with the National Employment Standards.
I note clause 6.3 of the Agreement, which gives precedence to the NES and am satisfied that the more beneficial entitlements of the NES will prevail where there is an inconsistency between the Agreement and the NES.
The United Workers Union (UWU) lodged a Form F18 statutory declaration, giving notice under s 183 of the Act that they want the Agreement to cover them. In accordance with s 201(2) of the Act, I note the Agreement covers the UWU.
The Agreement is approved and, in accordance with s 54 of the Act, will operate from 21 February 2025.
In accordance with clause 3.1, the nominal expiry date of the Agreement is 20 October 2028.
