Almeida and Australian Postal Corporation (Compensation)

The Administrative Appeals Tribunal considered a dispute between Ms Almeida and the Australian Postal Corporation concerning a claim for compensation. Ms Almeida sought compensation for alleged work-related injuries to her lower back, right elbow, and left knee.

The Tribunal was required to determine two primary issues: firstly, whether Ms Almeida suffered from an ailment as defined by the relevant Act, and secondly, whether any such ailment or aggravation of a pre-existing ailment was contributed to, to a significant degree, by her employment with the Australian Postal Corporation.

In reaching its decision, the Tribunal considered medical evidence from various specialists. It accepted that Ms Almeida suffered from mild degenerative changes in her lumbar spine, consistent with ageing, and tenderness or a minor strain in her right elbow, which had largely resolved. Regarding her left knee, the Tribunal found evidence of a degenerative lateral meniscus tear. However, the Tribunal found that Ms Almeida's employment did not contribute to these conditions to a significant degree. While one medical expert suggested her work aggravated pre-existing degenerative disease and contributed to her knee pain, the Tribunal noted inconsistencies in this evidence, including the expert's admission that Ms Almeida had no symptoms prior to the alleged work incident and did not report these issues during subsequent medical consultations.

Consequently, the Tribunal concluded that Ms Almeida did not suffer from a disease or injury that was significantly contributed to by her employment. Therefore, she was not entitled to compensation under section 14 of the Act. The Tribunal affirmed the decision under review.
