CaseChat Overview and Summary
The primary legal issue before the Commission was whether the proposed agreement provided for the proper operation of an enterprise, ensured fair and reasonable terms of employment, and adhered to the statutory provisions for enterprise agreements. The Commission had to examine the agreement's provisions and consider submissions from both parties, assessing if it met the criteria for approval.
In reaching its decision, the Commission considered the nature of the agreement, its provisions for minimum entitlements, and the process through which the agreement was negotiated. The Commission determined that the agreement contained provisions that met the statutory requirements for approval. It provided for the proper operation of the enterprise, ensured fair and reasonable terms of employment, and complied with the procedural requirements under the Fair Work Act.
The Commission approved the Boral Timber Narooma Enterprise Agreement 2019. The decision was made on the basis that the agreement met the legal standards for enterprise agreements and was deemed to be in the interests of the proper operation of the enterprise and the employees.
