CaseChat Overview and Summary

Allegion (Australia) Pty Ltd sought approval for the Allegion (Australia) Pty Ltd - Brooklyn Site - Enterprise Agreement 2025 under section 185 of the Fair Work Act 2009. The Australian Manufacturing Workers Union (AMWU) indicated its desire for the Agreement to cover its members, as per section 183 of the Act. The application was heard by Commissioner Mirabella in Melbourne on 30 September 2025.

The court was required to determine if the Agreement met the statutory requirements for approval under sections 186, 187, 188, and 190 of the Fair Work Act 2009. This involved assessing whether the Agreement was made in good faith, whether it contained certain mandatory terms, and if it adhered to procedural requirements, among other criteria.

Upon reviewing the application and the evidence presented, Commissioner Mirabella found that all relevant statutory requirements for the approval of the Agreement had been met. The Agreement was approved and will operate from 7 October 2025, with a nominal expiry date of 31 May 2028. The AMWU's notice under section 183 of the Act was also acknowledged, confirming that the Agreement would cover its members.

The court's final order was that the Allegion (Australia) Pty Ltd - Brooklyn Site - Enterprise Agreement 2025 is approved and will commence on 7 October 2025, concluding on 31 May 2028, unless terminated earlier in accordance with the Act.
