CaseChat Overview and Summary
This case involved a dispute between Ms Allanach (the applicant mother) and Mr Allanach (the respondent father) concerning the parenting of their two young children. The matter was before the Family Court of Australia and had been placed within the Magellan program due to significant allegations made against the mother and a maternal uncle. Interim parenting orders were made pending further review by a Magellan Registrar.
The primary legal issues before the Court were to determine the interim living arrangements for the children, the nature and extent of contact the mother would have with them, and what injunctive restraints were necessary to ensure the children's safety and well-being. The Court also considered the need to encourage a relationship between the children and both parents while simultaneously protecting them from harm, particularly in light of the serious allegations and the father's inconsistent reporting of concerns.
Collier J determined that, pending further material and expert reports, it was appropriate for the children to live with the father. The Court ordered that the mother would have unsupervised daytime contact with the children on Tuesdays between 3 pm and 6 pm during school terms, and on Tuesdays and Sundays from 9 am to 5 pm during school holidays, with special provision for Christmas Day. The Court also imposed restraints on both parties, prohibiting them from bringing the children into contact with the mother's brother, consuming illicit drugs within 24 hours prior to or during time with the children, using physical chastisement, or discussing the proceedings with or denigrating the other parent in the presence of the children. The parties were ordered to effect changeovers at a specific McDonald's restaurant or its car park.
