This matter concerned an application for a Visitor (Class FA) visa, Subclass 600, by Mr Ali Nadim, a Lebanese national. The applicant sought to visit family in Australia. The Tribunal was required to determine whether the applicant genuinely intended to stay temporarily in Australia for the purpose for which the visa was granted, as stipulated by clause 600.211 of the Migration Regulations.

The Tribunal considered several factors in assessing the applicant's genuine temporary entrant status. These included whether the applicant had complied substantially with the conditions of any previous substantive or bridging visa, whether the applicant intended to comply with the conditions of the Subclass 600 visa, and any other relevant matters. The applicant had not previously travelled to Australia, rendering clause 600.211(a) inapplicable in that regard. However, the Tribunal noted a previous visitor visa refusal in 2016. While the applicant's wife had visited Australia and returned to Lebanon within her visa period, the Tribunal considered this travel to have occurred a significant time ago, in 1999/2000. The Tribunal also considered the applicant's family circumstances in Australia, including that seven of his twelve children reside there and that his son operates a business in Australia.

The Tribunal found that the requirements of clause 600.211 were not met. Despite the applicant's stated intention to visit family, the Tribunal was not satisfied that he genuinely intended to stay temporarily in Australia. The presence of numerous family members, including sons operating a business in Australia, and the applicant's own business interests were considered in the context of potential incentives to remain in Australia. Consequently, the Tribunal affirmed the decision not to grant the visa.
