Algarme (Migration)

The Administrative Appeals Tribunal considered an application for a Skilled Independent (Permanent) visa (Subclass 189) made by Algarme and another applicant. The dispute arose after notices of taxation assessment were provided, and new evidence was subsequently submitted.

The primary legal issue before the Tribunal was whether the applicants met the criteria for the Subclass 189 visa, specifically in light of the new evidence presented. The Tribunal was required to determine if this new evidence satisfied the relevant legislative requirements.

The Tribunal, having reviewed the new evidence, was satisfied that the criterion for the visa was met. Consequently, the Tribunal concluded that the matter should be remitted for reconsideration. The Tribunal directed that the first named applicant meets the criteria under Cl.189.232 of Schedule 2 to the Regulations.
