CaseChat Overview and Summary
The central legal issues the Commission was required to address were whether the proposed enterprise agreement complied with the statutory requirements set out in the Fair Work Act 2009, and if it met the "better off overall test". This test requires that the proposed agreement must provide employees with at least the same pay and conditions as they would receive under existing awards or agreements, and must offer some form of benefit to at least half of the employees covered by the agreement.
The Fair Work Commission found that the proposed enterprise agreement was compliant with the statutory requirements and met the "better off overall test". The Commission noted that the agreement provided for fair compensation and conditions for employees, and that it included provisions for increased flexibility in work arrangements, which were beneficial to both the employer and the employees. The Commission was satisfied that the proposed agreement provided a positive outcome for the majority of employees and was therefore approved.
The Fair Work Commission approved the Airflite East Sale – Aerospace Maintenance Enterprise Agreement 2016 – 2019, subject to certain conditions and modifications. The Commission's decision ensures that employees of Airflite Pty Ltd will benefit from fair pay and conditions, while also allowing for flexibility in work arrangements.
