CaseChat Overview and Summary
The legal issues before the Commission were whether the proposed agreement complied with the statutory provisions and whether it passed the "better off overall test" (BOOT) as mandated by the Fair Work Act. This test required the Commission to assess if employees would be better off overall with the proposed agreement than under the applicable award or previous enterprise agreement. Additionally, the Commission had to consider the procedural fairness of the agreement and whether any provisions contravened the public interest.
The Commission found that the proposed agreement did indeed meet the BOOT, as employees would experience various benefits such as improved wages and working conditions, outweighing any potential detriments. The Commission also noted that the agreement had been negotiated in good faith and that the process adhered to procedural fairness principles. No provisions were found to contravene the public interest, and thus the agreement was deemed to be compliant with the statutory requirements. Consequently, the Commission approved the Air Refuel Pty Ltd Enterprise Agreement 2014.
