The primary legal issue before the Tribunal was whether AGC Services Pty Ltd, the incorporated company, qualified as the "standard business sponsor who last identified the holder of the Subclass 457 visa in a nomination" as required by regulation 5.19(3)(b)(i) of the Migration Regulations 1994. This required determining if the change in business structure from a partnership to a company, with different Australian Business Numbers and Australian Company Numbers, fundamentally altered the identity of the sponsoring entity for the purposes of the migration regulations.

The Tribunal affirmed the decision to refuse the nomination. The reasoning centred on the strict interpretation of regulation 5.19(3)(b)(i), which mandates that the nominator must be the same entity that previously identified the visa holder. Despite the continuity of business operations and ownership, the Tribunal found that the incorporation of the partnership into a company constituted a change in the legal identity of the nominator. Consequently, AGC Services Pty Ltd, as a new legal entity, was not the standard business sponsor who had last identified the nominee for the Subclass 457 visa. The Tribunal noted that the applicant's legal advisors had not raised concerns about the impact of the business restructure on the nomination process.
