CaseChat Overview and Summary
The legal issues before the commission involved determining whether the proposed agreement was fair and reasonable in all its terms, and whether the agreement had been appropriately negotiated and reached. The commission needed to consider the provisions of the agreement, the process through which it was negotiated, and the interests of the employees and employers involved. It was also necessary to consider whether the agreement met the statutory requirements for multi-employer agreements and if it provided for a fair and efficient workplace.
The Fair Work Commission found that the proposed agreement was fair and reasonable in all its terms. The commission noted that the agreement had been negotiated in good faith and was supported by a majority of the employees. The commission also found that the agreement provided for a fair and efficient workplace, and that it met the statutory requirements for multi-employer agreements. The commission concluded that the agreement was in the best interests of the employees and employers involved, and approved the agreement under section 233 of the Fair Work Act.
The final orders of the commission were that the Aegis Aged Care Group (ANF) Nurses Collective Workplace Agreement 2015 be approved as a registered agreement under section 173 of the Fair Work Act. The agreement was to be registered on the condition that any changes to the agreement must be approved by the commission under section 233 of the Act. The commission also ordered that the agreement be published on the Fair Work Commission's website.
