Application for approval of the AMWU and the ACCESS SAFETY SERVICES Pty Ltd Workshop Agreement 2020 - 2023.

[1] Application has been made by Access Safety Services Pty Ltd for approval of a single enterprise agreement known as the AMWU and the ACCESS SAFETY SERVICES Pty Ltd Workshop Agreement 2020 - 2023 (the Agreement).

[2] I am satisfied that each of the requirements of ss.186, 187, 188 and 190 as are relevant to this application for approval have been met.

[3] The Agreement is approved and, in accordance with s.54 of the Act, will operate from 2 October 2020. The nominal expiry date of the Agreement is 30 June 2023.

[4] The Agreement covers the “Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union” known as the Australian Manufacturing Workers’ Union (AMWU).

The Australian Building and Construction Commission (Commission) received an application from the Australian Manufacturing Workers' Union (AMWU) and Access Safety Services Pty Ltd (Access Safety) for approval of the AMWU and Access Safety Services Pty Ltd Workshop Agreement 2020-2023. The Commission held a hearing to consider the application and subsequently delivered its decision. The main issues before the Commission were whether the agreement complied with the relevant legislative provisions and if it contained provisions that would protect the interests of employees and employers.

The Commission noted that the agreement was intended to provide a framework for the employment of employees within the scope of the building and construction industry.
