ABULAFIA & GEARY

In the matter of *Abulafia & Geary*, heard by Hannam J, the dispute concerned applications made by the father and the mother. The father's amended application, filed on 5 February 2016, was ultimately dismissed by the court.

The court was required to determine the father's application and to make directions regarding the future conduct of the proceedings, including the obtaining of an updated expert report and the scheduling of a final hearing. The mother's application for costs was also reserved.

Hannam J dismissed the father's application. The court ordered that the Independent Children’s Lawyer forward consent orders for an updated expert report by Dr G to chambers within seven days. The final hearing was to be expedited, estimated to be a five-day trial, with dates to be allocated after June 2016, anticipating the availability of Dr G's report. The matter was to be relisted for further trial direction after the release of Dr G's report, with liberty to relist if the report's availability prior to the hearing dates became uncertain.
