Abu Quba and Secretary, Department of Social Services (Social services second review)

This matter concerned an appeal by Mr Abu Quba against the cancellation of his disability support pension by the Secretary, Department of Social Services. The central dispute revolved around whether Mr Abu Quba met the eligibility criteria for the pension at the time of its cancellation, specifically concerning the severity of his impairments and his continuing inability to work. The Administrative Appeals Tribunal was tasked with determining these issues.

The legal issues before the Tribunal were twofold: firstly, whether Mr Abu Quba possessed an impairment rating of 20 or more points according to the Impairment Tables; and secondly, whether he had a continuing inability to work as defined by the relevant legislation. The Tribunal considered evidence relating to Mr Abu Quba's long-standing spinal condition, including medical reports detailing surgical interventions and ongoing pain management, as well as his functional capacity as assessed by a general practitioner and his own statements to the Tribunal. The Tribunal's reasoning focused on the assessment of Mr Abu Quba's spinal condition against the Impairment Tables. While acknowledging the existence of his spinal condition and its treatment, the Tribunal found that it had a mild functional impact on activities involving spinal function, assigning five points under Table 4 – Spinal Function. This assessment was based on the medical evidence and Mr Abu Quba's own admissions regarding his ability to perform certain movements and travel. Consequently, the Tribunal concluded that his impairment rating did not reach the threshold of 20 points. As this primary criterion was not met, the Tribunal deemed it unnecessary to consider the second issue of his continuing inability to work.

The Tribunal affirmed the decision under review, finding that Mr Abu Quba did not qualify for the disability support pension during the relevant claim period.
