CaseChat Overview and Summary
The Commission considered the statutory requirements for an enterprise agreement, including whether the agreement provided for minimum wages, entitlements, and conditions of employment, and whether it had been negotiated in good faith. The Commission also evaluated whether the agreement contained appropriate dispute resolution provisions and whether it was likely to promote harmonious, productive, and equitable workplace relations. After reviewing the evidence and submissions from both parties, the Commission concluded that the agreement satisfied the statutory criteria.
Consequently, the Fair Work Commission approved the Aboriginal Health Council of South Australia Inc. Enterprise Agreement 2012. The Commission found that the agreement met all the necessary requirements and was likely to promote harmonious, productive, and equitable workplace relations. The approval signifies that the agreement can now be implemented, providing a framework for the terms and conditions of employment for the employees of the Aboriginal Health Council of South Australia Inc.
