Abbas (Migration)

The Administrative Appeals Tribunal considered a decision to cancel the visa of an applicant, Mr. Abbas. The dispute arose because the Minister, acting under section 116(1)(a) of the Migration Act 1958 (Cth), had cancelled Mr. Abbas's visa on the basis that the circumstances upon which it was granted no longer existed. The Tribunal also had to consider whether to exercise its discretion to cancel the visa, having regard to all relevant circumstances.

The Tribunal reasoned that the ground for cancellation was established because Mr. Abbas was no longer a member of Ms. Khalid's family unit. It found that the evidence did not satisfy the requirements of a genuine and continuing relationship, a mutual commitment to a shared life, or living together, as stipulated in the definitions of both spouse and de facto partner. The Tribunal considered the applicant's submissions regarding his personal circumstances, including his career aspirations in Australia and his desire for reconciliation with his wife, but concluded that these factors did not outweigh the finding that the basis for the visa grant no longer existed.

Ultimately, the Tribunal affirmed the decision to cancel Mr. Abbas's visa.
