Judgment

  1. COMMISSIONER: In this matter, at or after a conciliation conference, an agreement under s 34(3) of the Land and Environment Court Act 1979 (the Court Act) was reached between the parties as to the terms of a decision in the proceedings that was acceptable to the parties. As the presiding Commissioner, I was satisfied that the decision was one that the Court could have made in the proper exercise of its functions (this being the test applied by s 34(3) of the Court Act). As a consequence, s 34(3)(a) of the Act required me to “dispose of the proceedings in accordance with the decision”.

  2. The Court Act also required me to “set out in writing the terms of the decision” (s 34(3)(b)). The orders made to give effect to the agreement constitute that document.

  3. In making the orders to give effect to the agreement between the parties, I was not required to make, and have not made, any merit assessment of the issues that were originally in dispute between the parties.

  4. The final orders to give effect to the parties’ agreement under s 34(3) of the Land and Environment Court Act 1979 are:

  1. The Applicant is given leave to amend the development application and rely upon the following:

CaseChat Overview and Summary

In the case of A1 Green Garden Pty Ltd v Parramatta City Council, the plaintiff sought to challenge the defendant council's decision to cancel a permit that had been granted for the plaintiff to operate a gardening service within the Parramatta City Council area. The plaintiff argued that the decision was unreasonable and that they had been unfairly deprived of their livelihood. The matter was heard in the Supreme Court of New South Wales.

The court was tasked with determining whether the council's decision to cancel the permit was lawful and reasonable, and if the plaintiff's rights under the relevant legislation and common law principles were properly considered. The court needed to consider the circumstances surrounding the permit cancellation, the applicable statutory provisions, and the principles of natural justice and procedural fairness.

In examining the council's actions, the court found that the council had followed the correct procedures in cancelling the permit, and that the decision was based on valid grounds. The court held that the council had acted within its statutory powers and had not breached any principles of natural justice. The plaintiff's arguments regarding procedural fairness and the impact of the decision on their business were not sufficient to overturn the council's decision. Consequently, the court dismissed the plaintiff's claims.

The court ordered that the plaintiff's claims be dismissed, and that the plaintiff pay the defendant's costs of the proceedings.
