A Boccabella v Department of Natural Resources and Water

The appellant, A Boccabella, sought to appeal assessments of land valuations by the respondent, the Department of Natural Resources and Water. Boccabella argued that the valuations were erroneous and sought to challenge them. The matter was heard in the Queensland State Administrative Tribunal, which referred the issue of jurisdiction to the Queensland Court of Appeal.

The central legal issue was whether the Tribunal had the authority to hear Boccabella's appeals, given that they were filed beyond the statutory deadlines specified in section 57 of the Valuation of Land Act 1944. Boccabella contended that there was a reasonable excuse for the late filing, but the respondent argued that the statutory time limits were jurisdictional and could not be extended. The Court had to determine whether Boccabella's late filing was excused under the statute and, if not, whether the Tribunal had jurisdiction to hear the appeals.

The Court found that section 57 of the Valuation of Land Act 1944 clearly sets out the timeframe for appeals and does not provide for extensions or excusal of late filing. The Court held that the statutory period was jurisdictional and, without a reasonable excuse, the Tribunal did not have the authority to hear the appeals. Boccabella did not provide sufficient grounds to establish a reasonable excuse for the delay. Consequently, the Court determined that the Tribunal did not have jurisdiction to hear and decide the appeals.

As a result of this decision, the Court of Appeal ordered that the Tribunal did not have the jurisdiction to hear and decide appeals AV2007/0075, AV2007/0076, AV2007/0077, AV2007/0078, AV2007/0079, AV2007/0080, AV2007/0081, and AV2007/0082. These appeals were thereby dismissed for lack of jurisdiction.
