CaseChat Overview and Summary
The legal issues before the Commission included whether the agreement complied with the Fair Work Act 2009, whether it was made in good faith, and whether it provided for the proper operation of the business. Additionally, the Commission had to consider if the agreement provided for appropriate minimum terms and conditions, and whether it allowed for flexibility in the workplace.
In delivering its decision, the Fair Work Commission found that the agreement was largely compliant with the requirements of the Fair Work Act 2009. The Commission considered the good faith negotiation process and the need for the agreement to facilitate the proper operation of the employer's business. The Commission determined that the agreement provided for appropriate minimum terms and conditions and allowed for necessary flexibility. Consequently, the Commission approved the A & B Welding Pty Ltd Enterprise Agreement 2013.
