Application for approval of the 3M Australia Pty Ltd - Distribution Centre & National Union of Workers Collective Agreement 2017.
An application has been made for approval of an enterprise agreement known as the 3M Australia Pty Ltd - Distribution Centre & National Union of Workers Collective Agreement 2017 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by 3M Australia Pty Ltd. The Agreement is a single enterprise agreement.
The Employer has provided written undertakings. A copy of the undertakings is attached in Annexure A. I am satisfied that the undertakings will not cause financial detriment to any employee covered by the Agreement and that the undertakings will not result in substantial changes to the Agreement.
I observe that the following provisions are likely to be inconsistent with the National Employment Standards (NES):
· Clause 30.1 – annual leave; and
· Clause 33.7.1 - personal/carer’s leave.
However, noting clause 5(b) of the Agreement, I am satisfied the more beneficial entitlements of the NES will prevail where there is an inconsistency between the Agreement and the NES.
Subject to the undertakings referred to above, I am satisfied that each of the requirements of ss.186, 187, 188 and 190 as are relevant to this application for approval have been met.
The National Union of Workers being a bargaining representative for the Agreement, has given notice under s.183 of the Act that it wants the Agreement to cover it. In accordance with s.201(2) I note that the Agreement covers the organisation.
The Agreement is approved and, in accordance with s.54 of the Act, will operate from 26 July 2018. The nominal expiry date of the Agreement is 31 October 2020.

CaseChat Overview and Summary
The primary legal issue was whether the agreement was a "good faith" bargaining outcome, as required by section 233 of the Act. The court examined whether the agreement was negotiated in good faith and whether it provided fair and reasonable terms for the employees. The court also considered whether the agreement provided for appropriate mechanisms for resolving disputes and whether it aligned with the principles of the National Employment Standards and the Fair Work Act. Furthermore, the court needed to determine if the agreement was fair on a balance of all relevant considerations, including economic, social, and other relevant factors.
After carefully reviewing the evidence and submissions from both parties, the court found that the agreement was the outcome of good faith bargaining and provided fair and reasonable terms for the employees. The court was satisfied that the agreement contained appropriate mechanisms for resolving disputes and that it was in line with the principles of the National Employment Standards and the Fair Work Act. The court concluded that the agreement was fair on a balance of all relevant considerations. Consequently, the court approved the agreement, confirming its validity and enforceability.
The final orders of the court approved the 3M Australia Pty Ltd - Distribution Centre & National Union of Workers Collective Agreement 2017, effective from the date of the decision. The agreement was to be registered with the Fair Work Commission, and both parties were directed to take all necessary steps to give effect to the agreement and its terms. The decision also mandated that any disputes arising from the agreement were to be resolved in accordance with the procedures outlined within the agreement itself.
