The applicant sought review of a decision not to grant a protection visa. The dispute concerned whether the applicant met the criteria for a protection visa under the Migration Act 1958 (Cth), specifically whether they were a refugee or eligible for complementary protection. The court was required to determine if the applicant had a well-founded fear of persecution for reasons of political opinion or religion, or if there were substantial grounds for believing that, as a necessary and foreseeable consequence of removal to Fiji, the applicant faced a real risk of suffering significant harm. This involved assessing the applicant's claims of opposition to the previous Fijian government, restrictions on landowners, and challenges faced by Christians, against the legal definitions of "refugee" and "significant harm" as defined in the Migration Act.

The court affirmed the decision not to grant the protection visa. The applicant's claims regarding political opposition, land ownership issues, and religious persecution were not found to establish a well-founded fear of persecution for the purposes of section 5J of the Migration Act. Furthermore, the applicant did not satisfy the complementary protection criterion under section 36(2)(aa) of the Act, as there were no substantial grounds to believe a real risk of significant harm would be suffered upon removal to Fiji. The court noted that the applicant did not satisfy the criteria for being a member of the same family unit as a person who held a protection visa.
