The applicant, who sought a protection visa in relation to Taiwan, failed to attend a hearing before the Refugee Tribunal. The applicant subsequently failed to apply for reinstatement of their application within the prescribed 14-day period. The matter came before Dr Greg Weeks, a Member of the Tribunal.

The primary legal issue before the Tribunal was whether it was required to confirm the decision to dismiss the applicant's protection visa application, given the applicant's failure to attend the hearing and their subsequent failure to apply for reinstatement within the statutory timeframe.

Dr Weeks reasoned that the legislative framework mandated the confirmation of the dismissal decision in such circumstances. The Tribunal's discretion to reinstate an application was contingent upon a timely application for reinstatement. As the applicant did not apply for reinstatement within the 14-day period, the Tribunal was obliged to confirm the earlier decision to dismiss the application. The decision under review was therefore taken to be affirmed.
