The applicant sought a protection visa, claiming a well-founded fear of persecution in Vietnam due to his adherence to the Hoa Hao Buddhist religion and imputed political opinion against the Vietnamese communist government. The applicant alleged that local authorities closely monitored Hoa Hao members, arbitrarily arrested them, and that his family was also under surveillance. He feared being monitored, detained, questioned about his activities in Australia, and prevented from contacting other members of his religious group if returned to Vietnam. The case was heard by the Tribunal.

The Tribunal was required to determine whether the applicant had a well-founded fear of persecution for one of the five prescribed reasons under section 5J(1) of the Migration Act 1958, and if there was a real chance of such persecution upon return to Vietnam. Alternatively, the Tribunal had to consider if there were substantial grounds for believing that, as a necessary and foreseeable consequence of removal to Vietnam, the applicant faced a real risk of suffering significant harm as defined in section 36(2A) of the Act.

The Tribunal noted that the applicant had declined to attend a scheduled hearing, consenting to a decision based on the available documentation. The Tribunal considered the applicant's claims in light of the 'Refugee Law Guidelines' and 'Complementary Protection Guidelines'. Ultimately, the Tribunal found that the applicant had not satisfied the criteria for a protection visa under section 36(2) of the Act, either as a refugee or by facing a real risk of significant harm. The Tribunal affirmed the decision not to grant the applicant a protection visa.
