The applicant, a Fijian citizen, sought a protection visa in Australia. Specifically, it needed to assess whether the applicant had a well-founded fear of persecution based on race, religion, nationality, or political opinion, or if he faced significant harm as a necessary and foreseeable consequence of removal from Australia. The court also considered whether the applicant qualified as a member of the same family unit as another person who met these criteria.

The applicant initially claimed he had to leave Fiji due to harm from a former partner and her relatives, alleging authorities had sided with her. However, at the hearing, the applicant admitted these claims were fabricated by his cousin to support his application, stating he had no fear of harm upon returning to Fiji. The court found the applicant had not experienced harm in Fiji and did not have a well-founded fear of persecution. While the applicant expressed distress at being separated from his daughters in Australia, the court determined this distress did not meet the threshold for "serious harm" as defined by the Act, citing relevant case law. The court also found no basis for the applicant to be considered a member of the same family unit as a person who met the protection visa criteria.

Consequently, the Tribunal affirmed the decision not to grant the applicant a protection visa.
