Application for approval of the 1st Choice Interiors Pty Ltd Enterprise Agreement 2014.

[1] An application pursuant to s.185 of the Fair Work Act 2009 (“the Act”) was made on 24 July 2014 by 1st Choice Interiors Pty Ltd for the approval of a single-enterprise agreement known as the 1st Choice Interiors Pty Ltd Enterprise Agreement 2014(“the Agreement”).

[2] The Agreement was not lodged within 14 days after it was made. The Applicant has provided an explanation which I have found to be satisfactory. Pursuant to s.185(3)(b) I consider it fair to extend the time for making this application.

[3] I am satisfied that each of the requirements of ss.186, 187 and 188 of the Act as are relevant to this application for approval have been met.

[4] The Agreement is approved and will operate in accordance with s.54 of the Act.

In the matter of the Fair Work Commission, the applicant 1st Choice Interiors Pty Ltd sought approval of the 1st Choice Interiors Pty Ltd Enterprise Agreement 2014. The Fair Work Commission's final order was that the 1st Choice Interiors Pty Ltd Enterprise Agreement 2014 be approved as a registered agreement under the Fair Work Act 2009, effective from the date of the decision. This approval means that the terms and conditions set out in the agreement will apply to the employees covered by the agreement, replacing any applicable award provisions. The decision provides clarity and certainty for both the applicant and the respondent, ensuring that the agreement is enforceable and compliant with relevant legislation.
