CaseChat Overview and Summary

The applicant, a married woman from Sabah, Malaysia, sought review of a decision not to grant her a protection visa. She arrived in Australia with her husband and initially claimed to have left Malaysia due to her involvement in political issues, facing threats and blackmail from government supporters, and being physically assaulted at an anti-government parade. However, during the Tribunal hearing, she stated that these claims related to her husband, not herself, and that she had merely accompanied him.

The legal issues before the Tribunal were whether the applicant had a well-founded fear of persecution for one or more of the reasons specified in section 5J(1) of the Migration Act 1958, or, alternatively, whether there were substantial grounds for believing that her removal from Australia to Malaysia would result in a real risk of significant harm. The Tribunal was required to consider these claims in light of the Ministerial Direction No. 84, the Refugee Law Guidelines, the Complementary Protection Guidelines, and country information assessments.

The Tribunal found that the applicant's claims were not substantiated as they related to her husband, not herself, despite her initial application being framed as her own. She admitted to signing the application without reading it and stated her husband completed it, making decisions about the application. Her husband also indicated that his English was not proficient and he intended to explain matters at the hearing. Crucially, the applicant's husband had a separate protection visa application pending review. As the applicant did not satisfy the criteria under section 36(2)(a) or (aa) of the Act, and was not a member of the same family unit as a person who held a protection visa, the Tribunal concluded that she did not meet the criteria for a protection visa.

Consequently, the Tribunal affirmed the decision not to grant the applicant a protection visa.
