The applicant sought review of a decision by the Minister to refuse to grant a protection visa. The applicant had been notified of the decision to refuse the visa on 16 February 2018. The application for review was lodged with the Administrative Appeals Tribunal on 17 March 2018.

The primary legal issue before the Tribunal was whether the application for review had been made within the time prescribed by the relevant legislation, and consequently, whether the Tribunal had jurisdiction to hear the matter.

The Tribunal found that the applicant had failed to lodge the application for review within the statutory timeframe. As the application was received on 17 March 2018, which was after the expiry of the prescribed period following notification of the Minister's decision on 16 February 2018, the Tribunal concluded that it lacked jurisdiction to consider the application.

The Tribunal therefore made no order in relation to the merits of the protection visa application, as it had no jurisdiction to do so.
