The applicant sought review of a decision by the Minister to refuse to grant a protection visa. The Administrative Appeals Tribunal (AAT) was asked to determine whether it had jurisdiction to hear the application for review.

The central legal issue before the AAT was whether the application for review had been lodged within the time prescribed by the relevant legislation. The applicant's application for review was received by the Tribunal on 31 January 2018.

The AAT Member, Justin Meyer, found that as the application for review was not received by the Tribunal until 31 January 2018, it was not made in accordance with the relevant legislative requirements. Consequently, the Tribunal determined that it lacked jurisdiction to consider the matter.

The Tribunal made no orders as it found it had no jurisdiction.
