The applicant, a citizen of Thailand, sought review of a decision by the Minister for Immigration, Citizenship, Migrant Services and Multicultural Affairs to affirm the refusal of a protection visa. The applicant claimed to fear persecution in Thailand due to their political opinion, specifically opposition to the Constitutional Monarchy, and alternatively, membership in a particular social group defined as persons who fear harm because of having been accused of cheating people. The applicant had resided in Australia for a significant period and was considered a benefit to the Australian community.

The Federal Circuit Court was required to determine whether the applicant held a relevant political opinion that would engage Australia's non-refoulement obligations, or whether they belonged to a particular social group as defined. The court also had to consider whether the Minister's decision to affirm the refusal was affected by an error of law.

In his reasons, Judge Pennell affirmed the Minister's decision. The court found that the applicant's stated political opinion, while critical of the Thai monarchy, did not amount to a genuine subjective fear of persecution based on political opinion as understood in international refugee law. Furthermore, the court determined that the applicant did not establish membership in a particular social group, as the alleged accusation of cheating was not sufficiently linked to a well-founded fear of harm from the Thai state or non-state actors acting with its acquiescence. The court concluded that no error of law had been demonstrated in the Minister's assessment.
