The applicant, a Malay-Indian of Tamil ethnicity residing in Malaysia, sought review of a decision by the Migration Review Tribunal (MRT) concerning his application for a Protection visa. The applicant claimed he feared harm if returned to Malaysia due to his past association with a "gangster group" and his refusal to formally join them, alleging that the authorities would not provide him with effective protection.

The MRT was required to determine whether the applicant had a well-founded fear of persecution for a Convention reason, and if so, whether the Malaysian authorities would be unable or unwilling to protect him. This involved assessing the applicant's credibility regarding his alleged involvement with the gang and the nature of the "bad activities" he claimed to have been forced to undertake, as well as the likelihood of him facing harm from the group upon return. A key issue was whether the applicant could demonstrate a lack of effective protection from the Malaysian state.

The Tribunal found that the applicant's account of his involvement with the "gangster group" lacked credibility. While the applicant claimed to have had an "association" with the group and was pressured to participate in their activities, he also stated he never actually participated in any of their activities, including fighting and raping, even as an associate. The Tribunal noted that the applicant's claims of mistreatment stemmed from his refusal to formally join the group, yet he also asserted he was not a member and only listened to descriptions of their activities. Given these inconsistencies and the lack of evidence substantiating his claims of forced participation or direct threats of harm from the group, the Tribunal concluded that the applicant had not established a well-founded fear of persecution. Consequently, the MRT affirmed the decision to refuse the Protection visa.
