CaseChat Overview and Summary

The applicant, an Iraqi national, sought review of a decision by the Minister for Immigration, Citizenship, Migrant Services and Multicultural Affairs to refuse to grant a protection visa. The applicant claimed to fear persecution in Iraq due to his former membership in the Ba'ath Party, his Shia religious affiliation, and alleged death threats, corruption, and an attempted kidnapping. The applicant also argued that internal relocation within Iraq was not a viable option.

The primary legal issue before the court was whether the applicant had established a well-founded fear of persecution for a Convention reason, namely imputed political opinion or religion, or for other substantial reasons, such that he ought to be granted a protection visa under the *Migration Act 1958* (Cth). The court was required to consider the credibility of the applicant's claims and assess whether the objective country information supported his assertions of a real chance of suffering significant harm.

The court found that the delegate's assessment of the applicant's claims regarding his former Ba'ath Party membership and the associated risks was flawed. Specifically, the delegate failed to adequately consider the potential for imputed political opinion arising from past membership in the Ba'ath Party, particularly in the context of the prevailing security situation in Iraq involving militant religious groups and corruption. Furthermore, the delegate's assessment of the applicant's Shia religious identity and the risks associated with it, including death threats and an attempted kidnapping, was also found to be insufficient. The court concluded that the delegate had not properly engaged with the evidence and country information concerning the risks faced by individuals with the applicant's profile.

Consequently, the court set aside the decision under review and remitted the application to the Minister for reconsideration in accordance with the law.
