CaseChat Overview and Summary

The Administrative Appeals Tribunal considered whether a visa applicant, Ms Wang, genuinely intended to stay temporarily in Australia for the purpose for which a Subclass 600 Visitor visa was sought. The review applicant, Ms Wang's sister, sought to have the Tribunal's decision to refuse the visa affirmed.

The primary legal issue before the Tribunal was whether clause 600.211 of the Migration Regulations 1994 was satisfied. This required the Tribunal to be satisfied that Ms Wang genuinely intended to stay temporarily in Australia for the purpose of her visit, having regard to her compliance with the conditions of any previous visas, her intention to comply with the conditions of the proposed Subclass 600 visa (specifically, not to work in Australia and not to engage in study or training for more than three months), and any other relevant matters.

The Tribunal reasoned that while Ms Wang's compliance with previous visa conditions was not applicable as she had not previously travelled outside China, and the Tribunal had no concerns about her intention to comply with the conditions of the proposed visa, there were significant reservations about her credibility. These reservations stemmed from inconsistencies and vagueness in her evidence, including her failure to disclose details of past marriages and current relationships to the review applicant, and a discrepancy between her stated intention to visit for two weeks and an itinerary arranged by the review applicant suggesting a three-month stay. The Tribunal concluded that these factors, taken together, meant it was not satisfied that Ms Wang genuinely intended to stay temporarily in Australia for the purpose for which the visa was granted.

Consequently, the Tribunal affirmed the decision not to grant Ms Wang a Visitor (Class FA) visa, finding that the requirements of clause 600.211 were not met.
