This matter concerned an application for a Subclass 600 (Visitor) visa by a Vietnamese national, who sought to visit his Australian citizen brother. The Tribunal concluded that the applicant was the only family member in a position to travel to Australia and that his proposed visit for a few weeks during the Australian summer was consistent with a temporary stay.

The Tribunal determined that the requirements of clause 600.211 were met and remitted the application for reconsideration with a direction that the visa applicant met the specified criteria for the Subclass 600 visa.
