The Tribunal also noted their shared living arrangements since their marriage in October 2012, their attendance at family gatherings, and their stated intention to build a future together, including having children. Their families recognised their spousal relationship. Based on this evidence, the Tribunal concluded that the parties met the criteria for a spousal relationship.

The Tribunal remitted the application for reconsideration, directing that the applicant met the criteria for a Subclass 801 (Partner) visa under clauses 801.221(2) and 801.221 of Schedule 2 to the Regulations.
