CaseChat Overview and Summary
This matter concerned an application for a Partner (Temporary) (Class UK) visa, where the applicant claimed to be the spouse of the sponsoring Australian citizen. The core dispute revolved around whether the applicant met the definition of a spouse under section 5F of the Migration Act 1958 (Cth) and the relevant clauses of the Migration Regulations 1994, specifically clauses 820.211(2)(a) and 820.221. The decision was made by Hugh Sanderson, a Member of the Tribunal.
The Tribunal was required to determine whether the parties were in a valid marriage and, if so, whether they met the further requirements for a spousal relationship as defined by the Act and Regulations. These requirements include a mutual commitment to a shared life to the exclusion of all others, a genuine and continuing relationship, and living together or not living separately and apart on a permanent basis. The Tribunal also had to consider all circumstances of the relationship, including financial and social aspects, the nature of the household, and the commitment to each other, as outlined in regulation 1.15A(3).
The Tribunal found that the parties were validly married on 26 October 2013, satisfying the requirement of being married to each other under a marriage valid for the purposes of the Act. However, upon examining the financial aspects of the relationship, the Tribunal noted that while a joint bank account and travel insurance existed, both parties maintained sole name bank accounts into which their respective pays were deposited. The applicant's sole name account had an opening balance of $0.00 as at 14 December 2015, with details prior to that date not provided, and funds were only transferred to the joint account from February 2016. Furthermore, the joint account statements were sent to the sponsor's address in Canberra prior to the applicant moving to Sydney. These factors led the Tribunal to conclude that the applicant did not satisfy the criteria for the grant of the visa.
Consequently, the Tribunal affirmed the decision not to grant the applicant a Partner (Temporary) (Class UK) visa, finding that the applicant did not meet the requirements of clauses 820.211(2)(a) and 820.221.
