CaseChat Overview and Summary
The dispute between 1190 Pacific Highway Pty Ltd and Link Start Pty Ltd was heard in the Supreme Court of New South Wales. The primary issue was whether an existing caveat, lodged by Link Start, could be extended to cover a larger area of land than initially specified, which would encompass a parcel of land that 1190 Pacific Highway sought to transfer to a third party. The central question for the court was to determine whether the balance of convenience lay with Link Start in favour of extending the caveat, or with 1190 Pacific Highway in favour of proceeding with the transfer.
The court examined the principles surrounding the operation and extension of caveats in land law. It was necessary to consider whether the interests of Link Start in maintaining the caveat were sufficient to warrant its extension, and if the balance of convenience favoured Link Start's position. The court also considered the purpose of the caveat system, which is to protect a person's interest in land and to ensure that they are not unfairly deprived of that interest. In determining the balance of convenience, the court took into account the potential prejudice that either party would suffer if the caveat was or was not extended.
In its decision, the court held that the balance of convenience did not lie with Link Start. The court found that the potential prejudice to 1190 Pacific Highway in being unable to proceed with the transfer of the parcel of land outweighed any prejudice that Link Start might suffer if the caveat was not extended. The court also noted that the extension of the caveat would effectively defeat 1190 Pacific Highway's ability to deal with the land as it wished, which was not in line with the intended purpose of the caveat system. As a result, the court refused to extend the operation of the caveat to cover the additional parcel of land.
The Supreme Court of New South Wales ordered that the caveat lodged by Link Start be limited to the original area of land specified in the caveat, and that it did not extend to cover the additional parcel of land sought to be transferred by 1190 Pacific Highway. This decision allowed 1190 Pacific Highway to proceed with the transfer of the parcel of land to the third party, while still providing Link Start with the protection of its original caveat.
